TERMS AND CONDITIONS

This Web site is operated and owned by Sutler's Wines & Spirits, in accordance with the following Terms of Use. Please read these Terms carefully before using this site. By using this site, you agree to these Terms described in this policy. If you do not agree with these terms, please do not use this site.

YOU MUST BE 21 YEARS OF AGE OR OLDER TO USE THIS SITE.

1. Sales Terms

   All sales are F.O.B. 2225 Curve Crest Blvd - Stillwater MN, 55082. You assume all legal liability for wine and any other merchandise shipped from point of sale, and guarantee that you are 21 years of age or older. Purchase price excludes shipping, insurance, and sales tax.

2. Pick Up

   Orders placed before 3:00 pm will be ready for pick up after 5:00 pm that same day provided the requested merchandise is in stock. Orders received after 3:00 pm will be ready for pick up within 24 hours provided the requested merchandise is in stock. For your protection you will be asked to present the credit card used for the purchase, and a valid ID at the time of pick up.

3. Product Availability

   You will be notified by email within 24 hours if any part of your order is not available.

4. Returns and Defective Merchandise

   Any unopened or damaged products may be returned for a full refund within 5 days. All original packaging and broken bottles must be saved to receive proper credit. UPS will arrange a pick up of the damaged merchandise. Please contact us by email, wines@sutlers.com or by phone (651) 439-3399, to arrange for proper credit of your account.

5. Refused Shipments/Undeliverable Merchandise

   In the event that a Sutler's shipment is refused/undeliverable, we will call you. The product will be returned to inventory and a credit issued on your card, minus shipping and handling charges. Reshipment to an alternative address is extra and will be charged to your card to fulfill the delivery.

6. Metro Area and Out-State Deliveries

   Orders for delivery are generally shipped within two business days, unless the item requested is not in stock. All orders will be shipped FedEx or UPS Ground. During extreme hot and cold weather we will insist on using 2nd Day Air as an alternative shipping method in order to protect the quality of the merchandise. We will contact you and provide you with the increased cost before shipping. When choosing a shipping address please remember that a signature is required and the person signing for the delivery must be at least 21 years of age. It is therefore recommended that the shipping address be either a business or a residence where an adult will be home to receive the package. Deliveries will not be made without an authorized signature!

   Ground rates are as follows:
   1-2 bottles- $15.00
   1 case- $25.00

7. Fed-Ex Out of State Shipping Restrictions for Wine

   Sutler's can ship wine to: AK, AZ, CA, CO, CT, DC, FL, GA, HI, ID, IL, IN, IA, LA, MI, MN, MO, NE, NV, NH, NM, NY, NC, ND, OH, OR, SC, TX, VA, WA, WV, WI, WY . At this time, we are prohibited from shipping wine to any state not listed. For more information, contact us by email, wines@sutlers.com

8. Sales Tax on Merchandise and Shipments

   Sutler's is required, under Minnesota Department of Revenue Tax Code, to collect tax on the products it sells. Sutler's applies 9.0% tax on the subtotal of all alcoholic beverages and 6.5% on non-alcoholic merchandise.

10. Disclaimer of Warranty

    Sutler's expressly disclaims any and all warranties, express or implied, of title, merchantability, fitness for a particular purpose, with respect to any products purchased from this site or any information contained in this site.

11. Restrictions on Use

    This site is to be used for your personal, non-commercial use only. Any other use of this site, including the reproduction, display, modification, transmission, distribution, or transfer or sale, in whole or in part, of any information or content, obtained from this site is prohibited.

12. Changes

    Sutler's Wines & Spirits reserves the right to make changes to our site and these disclaimers, terms, and conditions at any time.

13. Indemnification

    You agree to defend, indemnify and hold harmless Sutler's Wines & Spirits, its affiliates, employees and agents, from any and all claims, damages and liability, of any nature whatsoever, arising out of the use of the site or the purchase of any products from this site. By placing an order, you are representing to Sutler's Wines & Spirits that your purchase complies with all federal, state and local laws.

14. Intellectual Property

    All contents (including text, trademarks, images, sound, service marks, graphics, logos) are the intellectual property of Sutler's Wines & Spirits, its content providers, advertisers, participating merchants, or other parties, Using the contents, in any manner, for commercial or public purposes, will constitute an infringement of Sutler's Wine & Spirits intellectual property rights and/or the rights of other parties.

15. Governing Law

    Any issues arising out of purchases you make using this website shall be governed by and construed according to Minnesota Law.
